The Queensland Government respects your privacy and has introduced a privacy scheme to ensure the responsible collection and handling of personal information in public sector agencies.

The Queensland Water Commission is committed to protecting user privacy. We understand and appreciate that individuals are concerned about their privacy and the confidentiality and security of any information that may be provided.

Information collected by the Queensland Water Commission

Our website does not use cookies and unless you specifically tell us, we will never know who you are.

Our Internet Service Provider's standard web logs record anonymous information for statistical purposes only, including:

  • The type of browser you are using;
  • Your traffic patterns through our site such as the:
    • date and time of your visit to our site;
    • pages you accessed and documents downloaded;
    • previous page you visited prior to accessing our site;
    • Internet address of the server accessing our site;
  • Access to information collected.

No attempt is made to identify your personal details except in the event of an investigation when a law enforcement agency may exercise a warrant to inspect the Internet Service Provider's logs.

Access to, and amendment of, personal information

Right of access to and amendment of, personal information under Information Privacy Principles 6 & 7 of Information Privacy Standard 42 is limited to existing rights under the Freedom of Information Act 1992.

As a general principle, a person is given access to personal information concerning the person’s own personal affairs, but not information concerning the personal affairs of another person. However, there are exemptions to access provided for in the Freedom of Information Act 1992.

Under the Freedom of Information Act 1992 information is classified as exempt matter if “its disclosure would disclose information concerning the personal affairs of a person whether living or dead, unless its disclosure would, on balance, be in the public interest.” It is in the public interest that a person has access to information held by government about him or her, so, in most cases, access will be granted. However, every case must be assessed on its merits by the person delegated by the Queensland Water Commission’s Chief Executive Officer to perform this function.

Requests for access to or amendment of records containing personal information must be made in writing to the Commission, as required by the Freedom of Information Act 1992, and set out the details of the information to which access is requested.  There is no application fee for access to personal information.

How the site handles email correspondence and feedback information

This is a Queensland Government website.  E-mail correspondence sent to this site will be treated as a public record and will be retained as required by the Public Records Act 2002  and other relevant regulations. It will also be subject to the provisions of the Freedom of Information Act 1992.

We will not add any details from your email to a mailing list without your permission, and will not disclose these details to third parties without your consent, unless required by law. Our Internet Service Provider monitors email traffic for system trouble shooting and maintenance purposes only.

Complaints and review 

If an individual believes that the Queensland Water Commission or a member of its staff has not dealt with the person’s personal information in accordance with Information Privacy Principles, a complaint may be made to the Commission. The complaint must be in writing and set out what occurred and what the person considers is the breach of the IPPs. The complaint should be made as soon as possible after the incident and in any case within six months from the date when the breach was suspected to have occurred, and should include as much detail as possible about the incident.  The Commission’s Privacy Complaint Form can be used to lodge a complaint.

Complaints may also be lodged via email to privacy@qwc.qld.gov.au.

Complaints will be acknowledged in writing within 14 days. The Commission will process each complaint within 30 business days from receipt and will advise the complainant of the Commission’s complaint investigation outcome, including any remedies that are considered appropriate to resolve the complaint.

If an applicant does not agree with this outcome, the applicant may apply in writing to the Privacy Contact Officer for review of the initial decision and outcome. Applications for review should be made in writing within 28 days of the complainant receiving the initial complaint decision.

A person who has not previously been involved in the matter will conduct the review. The review will be completed within 28 days of receipt of the application and the complainant notified in writing of the outcome.
